Filing

A 485-x project should have a filing calendar that sits beside its DOB, financing and construction calendars. The goal is to identify the decision owner, supporting records and deadline for every program milestone.

1. Establish and document commencement

Commencement is a statutory fact with downstream consequences. Preserve contracts, permits, site records, photographs and other evidence used by the project’s professional team to establish the date.

2. Submit the registration notice

HPD states that projects with a commencement date on or after April 20, 2024 generally must file the 485-x registration notice no later than six months after commencement. HPD may impose a penalty for untimely registration, subject to the governing law and rules.

3. Obtain and preserve the HPD docket sequence

After HPD Tax Incentive Programs assigns a docket sequence, use it consistently in project correspondence and document controls.

4. Prepare affordability workbooks where applicable

Options A and B require the applicable 485-x units workbook and affidavits. The workbook is a core operating document because the AMI bands, unit counts and rents need to reconcile with the development plan and later marketing/compliance work.

5. Marketing and monitoring

After an approved workbook for Options A/B, projects proceed through HPD marketing requirements, including the applicable notice and approved marketing-monitor structure.

6. File the option-specific application

HPD requires the appropriate application and supporting package. HPD’s current page also identifies the MWBE affidavit and a draft restrictive declaration specific to the project’s affordability option among required materials.

7. Record and operate the restrictions

Benefit approval does not end compliance. Project teams should calendar affordability, stabilization, wage, building-service, certification and ownership-transfer requirements for the entire applicable period.
